Products are not foods, drugs, dietary supplements, cosmetics, or medical devices, and have not been evaluated or approved by the U.S. Food and Drug Administration (“FDA“) for use in humans or animals.
2. Not for Human or Veterinary Consumption
Under no circumstances are Kinotype products to be administered to, ingested by, inhaled by, injected into, applied topically to, or otherwise introduced into the body of any human being or animal. Products are not intended to prevent, treat, mitigate, diagnose, or cure any disease, condition, or symptom.
3. No Medical Claims; No Doctor–Patient Relationship
Nothing on this website constitutes medical advice, diagnosis, or treatment. Kinotype does not employ or refer to physicians, pharmacists, prescribers, or other healthcare professionals in connection with the sale of its products. Any information published on this site about a compound’s chemical structure, molecular weight, receptor affinity, or mechanism of action at the receptor level is presented strictly as scientific reference material relevant to in‑vitro research and does not constitute a recommendation or instruction for any in‑vivo use.
4. Qualified-Researcher Representation
By accessing this website or placing an order, you represent and warrant that:
- You are at least 21 years of age;
- You are a qualified researcher, scientist, or accredited educational, scientific, or research institution acquiring these materials solely for legitimate in‑vitro laboratory or educational research;
- You will not administer, ingest, inject, or otherwise introduce any product into a human or animal subject;
- You will store, handle, and dispose of these materials in accordance with all applicable federal, state, and local laws, regulations, and good laboratory practices; and
- You will not resell, transfer, or redistribute any product for human or veterinary use.
5. Regulatory Status
Kinotype does not represent that any product is approved or cleared by the FDA, the Drug Enforcement Administration (“DEA“), the U.S. Department of Agriculture, or any state board of pharmacy. The regulatory status of certain compounds is evolving. Buyer is solely responsible for confirming the legal status of each compound in Buyer’s jurisdiction before ordering, receiving, possessing, or using the material.
6. Buyer Responsibility & Indemnification
Buyer assumes all risk associated with the purchase, receipt, possession, storage, handling, transfer, use, and disposal of Kinotype products. Buyer agrees to indemnify, defend, and hold harmless Kinotype, its members, managers, officers, employees, contractors, agents, suppliers, and affiliates from and against any and all claims, demands, suits, actions, damages, liabilities, losses, fines, penalties, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) Buyer’s purchase, possession, handling, storage, use, or misuse of any product; (b) Buyer’s breach of any representation, warranty, or covenant in these Terms; or (c) Buyer’s violation of any applicable federal, state, or local law or regulation.
7. No Warranty Beyond Stated Purity
Kinotype publishes per‑lot Certificates of Analysis evidencing the chemical identity and purity of each lot at the time of release. Kinotype disclaims all other warranties, express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, and non‑infringement, to the maximum extent permitted by applicable law. Products are sold strictly “AS‑IS” for in‑vitro research use.
8. Governing Law & Venue
This Disclaimer is governed by the laws of the State of Texas, without regard to conflict‑of‑laws principles. Any dispute arising out of or related to this Disclaimer that is not subject to arbitration under our Terms of Service shall be brought exclusively in the state or federal courts located in Hidalgo County, Texas, and the parties consent to personal jurisdiction and venue therein.
